How to Serve us a Subpoena
This web page provides information for an individual or an attorney seeking user data from Therapy Brands Holdings LLC dba Ensora Health or its subsidiaries (collectively, “Ensora Health”) in civil or criminal proceedings in the U.S. When Ensora Health receives requests for user data, we review them very carefully according to applicable state and federal laws. It’s Ensora Health’s policy to notify users before data is disclosed as set out here, unless it is subject to a valid law enforcement delay.
Civil and Criminal Requests
Ensora Health accepts all lawful requests for user data (including subpoenas and court orders) issued from an agency or court with lawful jurisdiction. You can serve Ensora Health with the request through the appropriate office of Ensora Health’s registered service agent, Corporation Service Company (or “CSC”).
The CSC office is located at the following address:
| Agent Name | Street | City | State | ZIP | County |
|---|---|---|---|---|---|
| Corporation Service Company | 251 Little Falls Drive | Wilmington | DE | 19808 | New Castle County |
Service through CSC will facilitate the most efficient handling of the request possible. Requests must specifically name the product/service and identify the accounts by email address or other appropriate unique identifier. Ensora Health is unable to accept service by email, fax, or regular mail.
How Ensora Health handles government requests for user information
Fraud Investigations
HHS, the DEA, DOJ, AUSAs, Medicaid fraud units, and other agencies in the United States ask Ensora Health to disclose user information. We carefully review each request to make sure it satisfies applicable laws. If a request asks for too much information, we try to narrow it, and in some cases we object to producing any information at all.
Upon receipt of a lawful demand for documents, we send an email to the user account before disclosure, unless subject to a valid law enforcement delay, as specified in our Business Associate Attachment at https://ensorahealth.com/legal/general-online-terms-and-conditions/. We won’t give notice when legally prohibited from doing so. We might not give notice if the account has been disabled.
Requests that Impact Patient Safety
If we reasonably believe that we can prevent someone from dying or from suffering serious physical harm, we may provide information to a government agency — for example, in the case of drug diversion. We still consider these requests in light of applicable laws and our policies.
